Privacy Collection Statement

Your and your parent/guardian’s personal information is being collected by Wyndham City Council to enable you to register for the Nightwalks with Teenagers by Mammalian Diving Reflex Program. The information will be stored in Council’s Customer Database and used to identify you or your parent/guardian when communicating with Council and for the delivery of services and administration of the program.  By registering your and your parent/guardian’s details, you consent to the collection, use and disclosure of your and your parent/guardian’s personal information as stated in the Terms and Conditions. The personal information will be handled in accordance with the Privacy and Data Protection Act 2014 (Vic).  For further information on how your personal information is handled, please visit Council’s Privacy Policy.

We strive to make our program inclusive. Please let us know if you have any dietary and/or access requirements to help us accommodate you in the program as best we can – e.g. "I am gluten intolerant" or "I am sensitive to loud noises and require a break-out space".

Please provide us with the contact information of someone we can reach in case of an emergency during the program. This information will only be used in the event of an emergency situation and will be kept strictly confidential.

 

Media release

Throughout the program, Wyndham City Council may be taking photos and/or videos. We will only use them for marketing and promotional activities, as well as funding and archival purposes.

Declaration

By submitting a registration to participate in the Nightwalks with Teenagers by Mammalian Diving Reflex Program (‘program’) you agree to be bound by these terms and conditions. I confirm that I have obtained written consent from my parent/guardian if I am under the age of 18.

These terms and conditions should be read in conjunction with other documents and information relating to the program, including your registration form and the information made available on Council’s website.

ELIGIBILITY AND TERMS AND CONDITIONS

To be eligible to submit a registration, you must be aged 14 - 18 years old. You must be able to provide evidence of your age if requested to do so by Council. 

REGISTRATION FORM

  1. Registrations open at 9:00am on  Monday 14 July 2025 and will close at 11:59pm on Thursday 11th September 2025 via Council’s website. Registrations that are incomplete or submitted outside of this period will not be accepted. 
  2. By submitting a registration for this program, you confirm that you have obtained consent from your parent or legal guardian if you are aged under 18;

    3. If you are aged 18, clause 2.2 does not apply to your registration. 

ASSESSMENT OF REGISTRATION FORM

  1. Up to 15–20 applicants will participate in the program.

    PROGRAM PARTICIPATION

    Program participants must be able to participate in the program in its entirety by attending all in-person program sessions between 2nd October 2025 and 12 October 2025, including the development of a performance to be presented as part of the Melbourne Fringe Festival showcase on 9th October 2025 - 12th October 2025. Devising the show is a collaborative, group-led process, supported by artists from Mammalian Diving Reflex.

Participants acknowledge that the locations for in person sessions and the performance are to be confirmed.

FINANCIAL SUPPORT

  1. No financial support or stipend will be provided to participants as part of this program. Any costs incurred by participants in connection with their involvement in the program are the responsibility of the participant.

     LIABILITY

    1. Participants understand and acknowledge that they participate in the program entirely at their own risk. 

    2. To the extent permitted by law, Council is not liable to any participant and their parent/guardian for any loss, damage, claim or expense suffered, including but not limited to property loss or damage or personal injury or death, as a result of or in connection with their participation in the program, except to the extent that any such loss is caused or contributed to by the negligent act or omission of Council.

    WITHDRAWAL OR CANCELLATION

    1. You or your parent/guardian if aged under 18, may withdraw from the program at any time by notifying Council by email to arts@wyndham.vic.gov.au.

  2. Council reserves the right to end your participation in the program where Council reasonably believes that you have:

    a) breached these terms and conditions; or
    b)failed to obtain written consent from your parent/guardian if you are under 18; or

    c) submitted false, inaccurate or misleading information in your EOI form or otherwise.

    3. Notwithstanding any other provision of these terms and conditions, and regardless of whether your participation in the program has been confirmed by Council, Council expressly reserves the right to cancel, change or modify the program or these terms and conditions at any time.

    NO RELATIONSHIP

    Nothing in these terms and conditions or in the conduct between an applicant and Council creates a relationship of agency, partnership, employer and employee or joint venture between the applicant and Council.
