If you need to repair or replace a fence that adjoins a Council owned or managed property, there are different processes to following depending on your scenario. 

Fences next to Parks and Reserves

The Fences Amendment Act 2014 specifies that Council is not considered the owner of a fence where it adjoins a public park or reserve. Despite the exemption, Wyndham City will provide a fencing contribution for the repair or replacement of a fence in certain circumstances, and for an amount at our discretion.

Acceptable circumstances include:

  • A fence adjoining a Wyndham City open space park or recreation reserve.
  • A fence adjoining a Wyndham City designated dog off lead area.

A contribution is not applicable for the following:

  • A fence adjoining a Wyndham City garden or tree reserve (eg. A section of land between a property boundary and a main roadway).

Fences next to Roadways including concrete Laneways and Cul-de-sacs

The Road Management Act 2004 specifies that Council is not obliged to fence or contribute to fencing along a Council roadway. Where a fence adjoins a roadway/nature strip, either along a property frontage or side boundary, the property owner is solely responsible for the cost of any fence repair or replacement. A fencing contribution is not available from Council for these scenarios.

Fences next to Council owned property

If your fence adjoins a Council Kindergarten, Community Centre, or other type of Council venue such as a Scout Hall, you may be eligible for a half cost contribution.

Fencing works for Kindergartens can only be conducted when the Kindergarten is closed for holidays, or over a weekend if the works can be completed by opening time on the Monday. The preferred option is to have works conducted during holiday periods. Kindergarten activities cannot be impacted by fencing works, and the safety of children is especially important where a fence adjoins an outdoor play area.

Fencing works for Community Centres and other venues also have their own work timeframe restrictions, and Council will advise appropriate scheduling.

Wyndham City must provide written confirmation of our contribution before a fencing contractor is engaged to commence works. Contribution applications will not be considered if the work has already been commenced/completed without prior consultation with Council.
