Privacy Collection Statement

Your personal information is being collected by Wyndham City Council for the purpose of administering your expression of interest to participate as a Mentor in the 2025 Wyndham Business Mentoring Program.  Any personal information you submit as part of your expression of interest will be stored and processed by Council and may be published in promoting Business Training programs.  By submitting your expression of interest, you agree to your personal information being stored, used, disclosed and published in accordance with the 2025 Voluntary Business Mentoring Provider Terms and Conditions.  Your personal information will be handled in accordance with the Privacy and Data Protection Act 2014 (Vic). Declaration

By submitting an application for to become a Voluntary Business Mentoring Provider, you agree to be bound by these terms and conditions.

These terms and conditions should be read in conjunction with any relevant information about the Voluntary Business Mentoring Providers Program (“Program”), e.g. your application, any information on Wyndham City Council Council’s website and any Council correspondence regarding the program.

  1. APPLICANT

    1.1 The person submitting this application on behalf of the business is jointly and severally liable together with the business to ensure compliance with these terms and conditions.
  2. ELIGIBILITY

    2.1 To be eligible to submit an application, the applicant must be a business that has a current, active ABN.
    2.2 Council staff, Councillors and their immediate families are ineligible to apply.
     
  3. ASSESSMENT OF APPLICATIONS

    3.1 All applications will be assessed by Council officers.  Applicants whose experience and skills are considered appropriate and relevant to the Wyndham business community may be selected to deliver mentorship sessions. 
    3.2 Council reserves the right to request further information from an applicant prior to determining the outcome of their application.
    3.3 Applicants will be notified of the outcome of their application within 20 business days of submission.
     
  4. SUCCESSFUL APPLICANTS

    4.1 Applicants who are selected by Council to become a business mentor agree to offer two (2) free mentorship sessions of at least 45 minutes in length each, for at least 3 local Wyndham businesses within the period of March to June 2026. 
    4.2 These sessions will be scheduled by the mentors and the mentees at the time that is suitable for both and can be online or in-person.
  5. BUSINESS PROMOTION

    5.1 Mentorship provider acknowledge and agree that Council will provide contact details of the Mentors to local businesses looking to access free mentorship.
     
  6. POST-SESSION EVALUATION

    6.1 Mentors acknowledge and agree that all participant evaluation of the mentorship session will be conducted by Council and that they must not undertake any of their own evaluation.  A de-identified copy of the participant evaluation will be made available to the mentorship provider by Council.
     
  7. CONFIDENTIALITY

    7.1 The Mentorship provider agrees to maintain the confidentiality of the Confidential Information of the Mentee’s business.

    7.2 The Mentorship provider will not be in breach of clause 7.1 where Confidential Information is required by law or regulation to be disclosed, provided the party that is required to make disclosure promptly notifies the Mentee’s business to whom the Confidential Information belongs to allow the latter party to assert whatever exclusions or exemptions may be available to it under such law or regulation.

    7.3 The Mentorship provider must ensure that its employees or agents given access to Confidential Information agree to be bound by and comply with the confidentiality obligations set out in these terms and conditions.
  8. INSURANCE

    8.1  Mentorship provider is classified as Volunteers for the purpose of this Program and will be covered by Council’s Liability Mutual Insurance Scheme.
     
  9. INDEMNITY

    9.1 Mentorship provider release, indemnify and continue to indemnify Council, its Councillors, employees, agents and contractors against all claims arising in connection with a breach or potential breach of these terms and conditions, including, without limitation, any infringement or potential infringement of third party intellectual property rights.
  10. NO REPRESENTATION

    10.1 Council makes no representation as to the minimum number of new clients that mentors may enjoy following the delivery of their sessions.
     
  11. NO RELATIONSHIP

    11.1 Nothing in these terms and conditions or in the conduct of the parties creates a relationship of agency, partnership, employer and employee or joint venture.
     
  12. WITHDRAWAL AND CANCELLATION

    12.1 Mentors may withdraw from the program at any time by notifying Council by email to business@wyndham.vic.gov.au.


    12. 2Council reserves the right, acting in its entire discretion, to:

    (a) change the time(s) and/or date(s) of a mentoring session;

    (b) cancel a mentoring session; or

    (c) cancel the program entirely.

    12.3 In the event of a change or cancellation by Council under condition 12.2, Council accepts no liability for any costs incurred by the mentors in anticipation of their sessions.

  13. GENERAL

    13.1 Mentors must comply with all laws, rules and regulations in connection with the delivery of their sessions. 

    13.2 Council may amend these terms and conditions at any time, without prior notice.
