Your personal information, and the personal information of your parent/guardian (if applicable) is being collected by Council to enable you to apply to participate in the One Wyndham Project (‘project’).  Your personal information will be used to communicate with you about the project in accordance with the One Wyndham Project Terms and Conditions.  The personal information will be stored in Council’s Customer Database with restricted access to those facilitating the project and used to identify you when communicating with Council.  For further information about how your personal information is handled, refer to Council’s Privacy Policy.

APPLICANT DECLARATION

These terms and conditions apply to the One Wyndham Project (‘project’).

By applying to participate in the project, you agree to be bound by these terms and conditions.

These terms and conditions should be read in conjunction with any relevant project information, e.g. your application form and any Council correspondence regarding the project.

Submission of an application does not confirm your participation in the project.  Successful applicants will be contacted by Council using the details provided in their application form.

 

  1. APPLICANT

    1.1 Applicants must be aged between 12 and 25 and must live, work, study or socialise in Wyndham.  Council staff, Councillors, members of the Wyndham Youth Governance Committee and their immediate family members are ineligible to apply.

    1.2 Applicants aged under 18 must have their parent/guardian’s consent to apply.  Applicants acknowledge that Council may contact the parent/guardian listed in their application form at any time to confirm that consent has been provided.

  1. APPLICATIONS

    2.1 Applications for the project will open quarterly.  The application period for each quarter is:

    2.2 To apply for the project, applicants must submit a properly completed application form at https://www.wyndham.vic.gov.au/form/one-wyndham-project-application during an application period.  Applications which are incomplete or received outside of an application period will not be accepted.

    2.3 Applicants agree to immediately notify Council of any changes to their application, including the request to withdraw their application, by emailing onewyndham@wyndham.vic.gov.au.

    2.4 Council accepts no responsibility for late, lost, incomplete, invalid or corrupt applications.

  1. ASSESSMENT OF NOMINATIONS

    3.1 Following the closing of each application period, Council staff and members of the Youth Task Force will assess all applications and nominations received and will select three people to participate in the project.

    3.2 Council will contact the successful applicants by email and telephone to advise them that they have been selected to participate in the project.

  1. ANNOUNCEMENT OF PROJECT PARTICIPANTS

    4.1 Council will announce each project participant as a One Wyndham Young Person of the Month by publishing their photograph and a brief profile about them:

    (a) on the One Wyndham page on Council’s website;

    (b) on Council’s social media pages, including but not limited to:

    (i) the Wyndham City Facebook page (https://www.facebook.com/wyndhamcitycouncil); and

    (ii) the Youth in Wyndham Instagram page (@youthinwyndham);

    (c) in an article published in Council’s monthly newsletter, Wyndham News; and

    (d) in a bi-monthly advertisement in the Star Weekly local newspaper.

    4.2 Participants agree to Council using the information they have provided in their application to be used to create the profile referred to in clause 4.1.

    4.3 Participants acknowledge and agree that their photograph and profile will be removed from the One Wyndham page on Council’s website upon the conclusion, withdrawal or cancellation of their participation in the project.

  1. PROJECT PARTICIPATION

    5.1 Participants agree to:

    (a) participate in the project for 12 months from the month that they are announced as a One Wyndham Young Person of the Month;

    (b) attend Council’s Youth Resource Centre to have their photograph taken, which will be used by Council in connection with clause 4.1;

    (c) appear in Council-filmed videos showcasing their participation in the project, which will be played in public areas of Council buildings and uploaded to Council’s social media pages and website;

    (d) participate any other project activities and events as reasonably required by Council, including, but not limited to, the End of Year Youth Celebration in December.

    5.2 Participants acknowledge and agree that project activities and events are subject to change and may be conducted using online technologies if they cannot be conducted in person.

    5.3 Participants acknowledge and agree that in recognition of their participation in the project, they will receive:

    (a) personalised certificate, presented to them at the End of Year Youth Celebration; and

    (b) GiftPay gift voucher valued at $200.

    5.4 Participants acknowledge and agree that terms and conditions apply to the redemption of gift vouchers. Refer to GiftPay’s website for further information.

  1. EXPECTED BEHAVIOUR

    6.1 Participants agree to follow all reasonable directions of Council staff during the project.

    6.2 Participants agree that at all times during the project, they will conduct themselves in a manner that upholds Council’s values and reflects prevailing community standards.

  1. PHOTOGRAPHY

    7.1 Participants consent to being photographed, filmed or otherwise recorded in connection with the project, including at any activities and events, and consent to Council’s use or publication of photographs and/or recordings in any format whatsoever, acting in its sole discretion.

    7.2 Participants may be required to provide their own photograph for Council to use in connection with clause 4.1.  Photographs provided by participants must not infringe another person’s copyright or intellectual property rights, and the participant grants Council a perpetual, irrevocable, transferable, sublicensable and royalty-free licence to use and publish that photograph (in whole or in part) for the purpose of announcing the participant’s participation in the project in accordance with clause 4.1.

  1. LIABILITY

    8.1 Participants participate in the project at their own risk.

    8.2 To the extent permitted by law, Council is not liable to any applicant, nominee or participant for any loss, damage, claim or expense (‘loss’) suffered, including, but not limited to property loss or damage, personal injury and death, as a result of or in connection with their application, nomination or participation in the project, except to the extent that any such loss is caused or contributed to by the negligent act or omission of Council.

  1. INDEMNITY

    Applicants, nominees and participants agree to hold harmless, indemnify and keep indemnified Council, its Councillors, staff and contractors (‘Council’) against any action, claim, demand, cost or other liability made against or incurred by Council in respect of any accident, damage, injury or loss arising from their application or nomination for, or participation in, the project and their compliance or purported compliance with these conditions.

  1. PROJECT WITHDRAWAL OR CANCELLATION

    10.1 Participants may withdraw from the project at any time by notifying Council in writing.

    10.2 Council reserves the right to end a person’s participation in the project where they have breached these conditions, or where false, inaccurate or misleading information has been submitted in their application, nomination or otherwise.

    10.3 Notwithstanding any other provision of these conditions, and regardless of whether a person’s participation in the project has been confirmed by Council, Council expressly reserves the right to cancel, change or modify the project or these conditions at any time.

  1. NO RELATIONSHIP

    Nothing in these conditions or in the conduct of Council and an applicant, nominee or participant will create a relationship of agency, partnership, employer and employee or joint venture between the applicant or participant and Council.
