Your personal information is being collected by Council to enable you to enter the Wyndham Art Prize 2022 and will be used and disclosed to members of the judging panel in the administration of the competition. By entering the competition, you agree to the collection, use and disclosure of your personal information as stated in the Wyndham Art Prize 2022 Terms and Conditions.  Your information will be stored in Council’s Customer Database and used to identify you when communicating with Council and for the delivery of services and information.  For further information on how your personal information is handled, visit Council’s Privacy Policy at www.wyndham.vic.gov.au/privacy-policy.

Declaration
  1. This competition is run by Wyndham City Council (‘Council’) in the state of Victoria, Australia only.
  1. By entering this competition, I agree to accept these terms and conditions of entry.  If my entry does not comply with these terms and conditions, it will not be valid and will not be accepted.
  1. Entry is restricted to Australian citizens and permanent residents who have resided in Australia for at least 12 months.  Wyndham Art Prize 2021 winners are able to enter the competition but are ineligible for any of the prizes.
  1. Entrants aged under 18 years of age must obtain their parent or guardian’s consent to enter this competition.  Council staff, Councillors and their immediate families are not eligible to enter.
     
  2. To be eligible for the Local Emerging Artist Prize, entrants must:

    (a) be a resident of Wyndham;
    (b) be 5 years or less into their professional practice as an artist; and
    (c) not be a previous Wyndham Art Prize winner in any category.

  1. The competition opens at 9:00am on Tuesday 1 February 2022 and closes at 9:00am on Friday 1 April 2022 (‘competition period’).  Entries received outside of this competition period will not be accepted.
  1. To enter the competition, between the competition period, applicants must:

    (a) visit https://www.wyndham.vic.gov.au/wyndhamartprize2022 and:

    (i) upload a digital image of their artwork;
    (ii) upload a copy of their CV; and
    (iii) submit a properly completed entry form; and

    (b) pay the $35 per entrant non-refundable administration fee.

  1. If artwork is in video format, a URL link to the video must be provided in the entry form.
  1. Digital images of your artwork must be:

    (a) in JPEG format;
    (b) between 1mb and 3mb in file size;
    (c) at 300 dpi resolution; and
    (d) saved using the following file name format: surname_firstname_titleofartwork.

  1. Applicants must pay the administration fee at www.eventbrite.com.au/e/wyndham-art-prize-2022-entry-fees-tickets-251031771787 by 9:00am on Friday 1 April.
  1. Applicants acknowledge and agree that unless requested, receipts for payment of the administration fee will not be provided.
  1. A maximum of two artworks per entrant will be accepted.
  1. Artwork entered into the competition must:

    (a) have been completed after 1 February 2017;
    (b) be available for display at the Wyndham Art Gallery between Monday 9 May 2022 until Friday 12 August 2022 (exhibition dates Thursday 2 June to Sunday 7 August 2022);
    (c) be no larger than 1.5m x 1m in dimension;
    (d) be professionally prepared for hanging and/or installation; and
    (e) be clearly marked on the reverse with the entrant’s name, address and the title of the artwork.

  1. Entries must be the artists’ own original work and must not contain any objectionable, profane, insulting, inflammatory or defamatory material, or infringe a third party’s intellectual property rights.
  1. Applicants acknowledge and agree that the artist retains copyright in their artwork.
  1. Where a person is capable of being identified in an entry, the applicant must obtain that person’s consent for inclusion in the entry.  Evidence of receipt of any such consent must be provided to Council upon request.
  1. Judging to shortlist entries will commence on Monday 11 April 2022.  Shortlisted entrants will be contacted by Council no later than Tuesday 19 April 2022.
  1. Shortlisted entrants must, at their own cost and at their own risk, ensure that their artwork is delivered to the Wyndham Art Gallery between Monday 9 and Wednesday 11 May 2022 and is collected between Wednesday 10 and Friday 12 August 2022, between the hours of 10:00am and 4:00pm only.  Council may, acting in its absolute discretion, agree to an alternative delivery or collection time.
  1. If the shortlisted entrant uses a courier to deliver and collect their artwork, they must ensure their artwork is sufficiently packed for delivery, provide their return postal address and supply Council with a consignment note for collection of the artwork by a courier by Monday 2nd May 2022.  Council will repackage the artwork prior to collection using the existing packing only.
  1. If required by Council, shortlisted entrants must provide installation instructions for their artwork.
  1. Council may, acting in its entire discretion, determine not to display a shortlisted entrant’s artwork at the Wyndham Art Gallery.
  1. Council’s judging panel will determine two competition winners from all shortlisted entries; the winners of the Wyndham Art Prize and the Local Emerging Artist Prize categories. The People’s Choice Award winner will be awarded to the entrant whose artwork receives the most votes from visitors to Wyndham Art Gallery
  1. Winners will receive the relevant cash prize amount listed below (total prize pool valued at $20,000).

  1. The winners of the First Prize and Local Emerging Artist Prize will be announced at the Wyndham Art Prize Exhibition opening, to be held at the Wyndham Art Gallery between 6:30pm and 8:30pm on Thursday 2 June 2022.
  1. The winner of the People’s Choice Award will be announced at an exhibition launch to be held at the Wyndham Art Gallery between 6:30pm and 8:30pm on Thursday 25 August 2022.
  1. Applicants acknowledge and agree that the Wyndham Art Prize Exhibition, voting for the People’s Choice Award and winner announcements may be conducted online instead of, or as well as, being conducted in person at the Wyndham Art Gallery.
  1. All winners’ names will be published in a Council media release and on Council’s website and social media pages. Winners consent to their names and images of their artwork being published by Council.
  1. The winner of the Local Emerging Artist Prize acknowledges and agrees that the Local Emerging Artist Prize is an acquisitive prize and that title to the winner’s artwork will pass to Council upon payment of the cash prize amount. The winner further agrees to enter into any agreement(s) that Council may reasonably require to give effect to the acquisition of the winner’s artwork.
  1. If a winner cannot be contacted by Monday 13 June 2022, Council may opt to conduct further judging to determine a new winner.
  1. If a prize has not been claimed by Monday 13 June 2022 the winner will be deemed to have surrendered the prize and Council may opt to conduct further judging to award the unclaimed prize.
  1. Council reserves the right not to award a prize in any category.
  1. Prizes are not transferable.
  1. Council may, acting in its entire discretion, require winners to provide evidence of their identity, address and/or residency.
  1.  Winners and finalist entrants grant the Council a royalty-free, non-exclusive non-commercial licence to use and publish their artwork including (in whole or in part) their artist statement, in print or online for the purpose of promoting the Wyndham Art Prize and Wyndham Art Gallery as follows:

    (a) as part of the Wyndham Art Prize Exhibition at Wyndham Art Gallery from Thursday 2 June 2022 until Sunday 7 August 2022; and
    (b) in any Council promotional material, including without limitation, the catalogue for the Wyndham Art Prize Exhibition; and
    (c) on Council’s websites and social media pages with the use of low-resolution images only to avoid copyright abuse.
    (d) For the winner of the LEAP prize this licence is granted in perpetuity. For the winners of the First Prize and the People’s Choice Award and all finalists this license will be for a period of five years aside from archival use which is granted perpetually.

  1. The artist will always be credited whenever their work is used and exhibited. No changes, edits or alterations will be made to an artwork without first obtaining the prior written consent from the artist, unless such changes are reasonable cropping on reproductions for layout purposes. Any digital display of the works will be low resolution to prevent copying.
  1. Applicants acknowledge and agree that they are responsible for the insurance of their artwork for transport to and from the gallery, and further acknowledge and agree that Council recommends that all shortlisted entrants obtain appropriate insurance cover. The Council is responsible for the artwork while in its care including storage, handling and display.
  1. Each party releases, holds harmless, indemnifies and continues to indemnify the other party for any claim, costs, loss and liability incurred or suffered by a Party arising out of the indemnifying party's breach of these Terms and Conditions and/or negligent or wrongful; act of omission in connection with the Wyndham Art Prize including, without limitation, any infringement of third-party intellectual property rights.
  1. Applicants acknowledge and agree that if they do not collect their artwork from the Wyndham Art Gallery by Friday 12 August 2022, their artwork:

    (a) will be deemed to be abandoned;
    (b) will become the property of Council; and
    (c) may be disposed of in any manner as Council sees fit, including by sale or auction.

  1. Council accepts no responsibility for late, lost, incomplete, corrupt or invalid entries.
  1. If for any reason, the competition cannot be run as planned, Council reserves the right to cancel, terminate, modify or suspend the competition. In this case the artists’ work will be returned to them.
  1. Council reserves the right to change or modify these conditions at any time.
  1. Council’s decisions are final and no correspondence will be entered into.
