By booking or participating in the WyndhamAI Business Concierge (the Service), you agree to the following terms and conditions.
1. About the Service
The Service is a free, light-touch advisory service delivered by RMIT University (RMIT) in partnership with Wyndham City Council (the Council). It provides general, vendor-neutral guidance to help businesses explore potential artificial intelligence (AI) opportunities, undertake an indicative readiness check and identify possible next steps. The Service does not include software implementation or configuration, systems integration, procurement services, formal vendor due diligence, legal or regulatory advice, cybersecurity or privacy assurance, detailed technical solution design, or a formal consulting report.
2. Eligibility
The Service is primarily available to small and medium-sized businesses based or registered in the City of Wyndham. Selected community organisations and sector stakeholders may also be considered where appropriate. RMIT and the Council may accept, decline or prioritise applications based on eligibility, fit with the Service, available capacity and program objectives, and may limit the number of sessions available to any one business.
3. Nature of the advice
The Service provides general, exploratory business and technology guidance based on the information you provide and the circumstances existing at the time of the session. It does not constitute legal, financial, taxation, accounting, investment, procurement, cybersecurity, privacy, regulatory or compliance advice. It is not a detailed technical assessment, assurance engagement, software implementation service or formal consulting report.
You remain responsible for your own business, technology, procurement and implementation decisions. You should obtain appropriately qualified professional advice before making significant business, legal, financial, security, privacy, regulatory or technology decisions.
4. Tools and vendors
Any reference to a particular AI tool, platform, product, service or vendor is illustrative and provided for general information only. It does not constitute an endorsement, procurement recommendation, guarantee or formal due diligence assessment, or a representation that the product or vendor is suitable for your circumstances. The Service is intended to provide vendor-neutral guidance and is not subject to an obligation to promote a particular product or vendor. The Service does not receive referral commissions in connection with referrals made through the Service. You are responsible for evaluating any product or vendor, including its functionality, pricing, security, privacy, data-handling arrangements, licensing terms, contractual conditions and regulatory implications.
5. No guarantee of outcomes
While the Service aims to provide practical and useful guidance, RMIT and the Council do not guarantee any particular outcome, benefit, cost saving or result for your business. Referrals to next-step pathways (such as WyndhamAI Sprints, learning opportunities or other programs) are suggestions only. Referred programs or providers may have separate eligibility requirements, fees, terms and availability, and a referral does not guarantee acceptance.
6. Bookings, cancellations and availability
• Appointments are subject to availability and must be booked through the application process on the Wyndham City website.
• Please provide at least 24 hours' notice if you need to cancel or reschedule an appointment.
• If you fail to attend a scheduled appointment without notice, we may deprioritise future bookings.
• RMIT and the Council may vary session times, locations, format (face-to-face or online), and the specialists delivering the Service.
7. Cost
The Service is provided free of charge. You are responsible for your own costs of participating, including travel and any costs of acting on guidance received.
8. Your information, privacy and confidentiality
Personal information collected through the application process or during participation in the Service will be collected, used, held and disclosed as described in the Privacy Collection Notice, the Council's Privacy Policy, the RMIT Privacy Statement and applicable law. Council may provide relevant information to authorised RMIT personnel and approved service providers involved in administering or delivering the Service. Information will only be provided to another program, vendor or implementation provider for a referral with your consent, unless disclosure is otherwise required or authorised by law.
RMIT and the Council will take reasonable steps to protect confidential business information provided for the purpose of the Service. This does not apply to information that is already lawfully public or known, independently developed, disclosed with your consent, or required or authorised to be disclosed by law. As Council is a public authority, documents held by Council may be subject to lawful information-access requirements. You should not provide passwords, access credentials, raw personal or sensitive information, customer or employee records, production data, source code, trade secrets or other highly sensitive information unless separate secure arrangements have first been agreed in writing.
Aggregated information that does not reasonably identify you, any individual or your business may be used for program administration, service evaluation, funding accountability, reporting and improvement. Identifiable application or session information will not be used for academic research without any required ethics approval and a separate participant information and consent process. Participation in research will be voluntary and will not affect eligibility for the Service.
9. Intellectual property
You retain ownership of business information, documents and materials you provide and grant RMIT and the Council a limited, non-exclusive licence to use them only as reasonably necessary to assess your application, administer and deliver the Service, undertake agreed referrals, and carry out permitted program evaluation and reporting. Unless otherwise stated, intellectual property in materials created or supplied by RMIT, the Council or a third party remains with the relevant owner. Materials provided to you through the Service are licensed for your internal business use only. Unless expressly agreed otherwise, the Service does not include a formal written report, technical design, software, source code or implementation deliverable.
10. Liability
Nothing in these terms excludes, restricts or modifies any right, guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified. Subject to that and to the maximum extent permitted by law, RMIT and the Council exclude liability for indirect or consequential loss, including loss of profit, revenue, data, business opportunity, anticipated savings or goodwill, arising from participation in or reliance on the Service, decisions made following a session, the selection or use of third-party tools or vendors, or participation in a referred program.
11. Conduct
We are committed to providing a safe and respectful environment. RMIT and the Council may decline or discontinue service to any person who behaves in a manner that is abusive, threatening, unlawful, or otherwise inappropriate. Sessions must not be photographed, recorded or transcribed using automated tools without the prior consent of all participants.
12. Changes to the Service and these terms
RMIT and the Council may modify, suspend or discontinue the Service, including its availability, format, locations, personnel or scope. Where reasonably practicable, affected participants will be given notice of a material change or cancellation. The version of these terms accepted when an appointment is confirmed will apply to that appointment. Updated terms will generally apply to future applications and bookings and will not operate retrospectively, except where a change is required by law or is reasonably necessary to address safety, security, privacy or operational risk. The current version and effective date will be published on the Service webpage.
