Existing Planning Permit Requests

Once you’ve got your planning permit, you may need to make changes to the permit. 

This could include things like: 

  • changing what the permit allows 
  • changing a condition on the permit 
  • changes to your plans 
  • adding another use of land 
  • extending the time of the permit. 

Amend your planning permit

You will need to apply under Section 72 of the Planning and Environment Act to amend your planning permit if you need to: 

  • change what the permit allows 
  • change or delete a condition on the permit 
  • amend the plans 
  • add a new use of land.

Applying for an amendment is a similar process to applying for a new planning permit. As part of your application, you will need to supply: 

  • a copy of the Certificate of Title for your property 
  • a site layout plan 
  • a written statement about your proposal 
  • a detailed description of the changes you are making.

Amend your planning permit

Once we receive your application, we may contact you for more information about your application, which could include extra plans or documents. 

We will then advertise your planning permit to notify surrounding property owners of your plans and give them a chance to lodge an objection. 

Secondary consent for minor changes

If the changes to your plans are considered minor, you may be able to apply for a secondary consent instead. 

To be considered as a secondary consent, your proposal: 

  • cannot transform the permit to a use or development that was not previously considered or approved 
  • cannot approve changes that require a planning permit or which are contrary to any specific condition in the original permit 
  • must not alter the description of what is allowed in the permit 
  • must not vary or delete any permit conditions 
  • must not make any changes that may negatively impact the surrounding environment.

Apply for secondary consent

Our planning officers will consider your application. If they decide your proposal cannot be accepted under secondary consent, they will let you know how to apply to amend your permit or apply for a new one. 

Extend your planning permit 

If you have had a delay and will not be able to meet the commencement or completion dates on your permit, you will need to apply for an extension of time. 

To be eligible to extend your permit, you must apply for the extension before the permit expires or within 6 months of the expiry date. 

If you have started construction and need an extension of time to complete construction, you must apply for the extension within 12 months of the expiry date.

Satisfy a condition of your planning permit

Conditions of your permit may require you to submit additional plans or other material for endorsement.  For example, Condition 1 of a permit often requires amended plans to be submitted. 

You will need to complete the form and include any relevant plans or documents.

Cultural Heritage Management Plan Declaration

If a Cultural Heritage Management Plan is not required, you need to complete a Cultural Heritage Management Plan Declaration Form and submit the completed form to Wyndham City.
