Privacy Collection Statement

Your personal information, and that of your parent or legal guardian (if applicable), is being collected by Wyndham City Council for the purpose of administering your submission to the Q Art Project.  The personal information you provide as part of your submission will be stored in Council’s Customer Database and used to identify you when communicating with Council and for delivery of services and information.  By making a submission to the Q Art Project, you consent to the collection, use and disclosure of this personal information as stated in the Q Art Project Terms and Conditions.  Your personal information will be handled in accordance with the Privacy and Data Protection Act 2014 (Vic).   1. By making a submission to and participating in the Q Art Project (‘project’) you agree to be bound by these terms and conditions.
     
  2. To be eligible to make a submission to the project, you must be aged between 12 and 25 and live, work, study, socialise, or otherwise have a connection to Wyndham.  If you are under 18, you must obtain your parent or legal guardian’s consent to make a submission to the project.  Council staff, Councillors, Headspace employees and their immediate families are not eligible to make a submission.
     
  3. Submissions will be accepted from 9:00am on 25 September 2023 until 5:00pm on 17 November 2023.  Submissions received outside of this period will not be accepted. 
     
  4. To make a submission, you must upload your submission and a properly completed online submission form via Council’s website.
     
  5. Multiple submissions per person will be accepted, provided that each complies with these terms and conditions.
     
  6. Your submission must be your own original work and must not contain any objectionable, offensive, insulting, inflammatory or defamatory material.  You warrant that your submission does not infringe a third party’s intellectual property rights.
     
  7. If your submission is a written piece, it must meet the following word limits and be submitted as a Microsoft Word document (portrait orientation):

          a) Short story: between 1,500 and 2,000 words.

          b) Poem: no more than 500 words.

  1. Poems and short stories may be submitted in a language other than English, provided that it is accompanied by an English translation of the same.
     
  2. If your submission is an image, its file size must be no larger than 10MB and must meet the following specifications:

    a) Photograph: .jpeg format with a minimum resolution of 300 dpi.

    b) Photoshop scan: minimum resolution of 300dpi.

         c) Illustrator image: minimum resolution of 600dpi.

  1. If your submission is a song:

    a) it must be no longer than 3.5 minutes in duration;

    b) it must not contain any coarse language;

    c) it may be submitted either by uploading an MP3 file of the song which must be no larger than 10MB in size, or by providing an online link to the song (e.g. Spotify); and

    d) you must provide a copy of the song lyrics (including English translation if applicable) with your submission.
     

  2. If a person is identifiable in your submission, you must obtain that person’s consent (or their parent/guardian’s consent if the person is under 18) to be included in your submission and for your submission to be submitted to and published in connection with this project.  Evidence of any such consent required must be provided on request.
     
  3. Submissions will be considered between 20 and 24 November 2023 by a panel consisting of Council Officers and Headspace Werribee employees.  Submissions will be chosen for publication based on the selection criteria on Council’s website
     
  4. If your submission(s) is/are selected for publication, you be notified by Council by email or phone no later than 5:00pm on24 November 2023 and you will receive one $100 GiftPay e-gift card.  You acknowledge that the e-gift card will be sent by email to the email address provided in your submission form and that Council accepts no responsibility for lost e-gift cards.  Refer to GiftPay’s website for terms and conditions for the redemption of e-gift cards.
     
  5. You acknowledge that you retain copyright in your submission.
     
  6. You grant Council a perpetual, irrevocable and royalty-free licence to publish, cause to be published or otherwise use your submission (whether in whole or in part) in any format whatsoever:

    a) as part of a project exhibition (times, dates and locations to be confirmed);

    b) published on Council’s website and social media pages for the purpose of promoting the project; and

    c) in a digital e-book about the project to be published on Council’s website.
     

  7. You acknowledge that upon publication of your submission online, it will become publicly accessible and will be capable of being shared, saved, downloaded or otherwise distributed by the public.  You acknowledge and agree that Council accepts no responsibility or liability for the way that members of the public use, share, save, download or otherwise distribute your submission once it has been published.
     
  8. You acknowledge and agree that Council may publish your name in connection with your submission, subject to compliance with the form of acknowledgement specified in your submission form.
     
  9. If you have provided your social media handles or profile links, you acknowledge and agree that Council may, at its discretion, publish these in connection with your submission.
     
  10. You acknowledge and agree that you make your submission to, and participate in, the project entirely at your own risk and that Council is not liable to you for any loss, damage, claim or expense suffered as a result of or in connection with your submission to or participation in the project.
     
  11. You must indemnify and hold harmless Council, its councillors and employees against all claims arising in connection with a breach or potential breach of these terms and conditions.
     
  12. Council accepts no responsibility for late, lost, incomplete, invalid or corrupt submissions.
     
  13. If your submission is selected for exhibition, you must deliver it to and collect it from the Youth Resource Centre at the times and dates as agreed with Council.  You acknowledge and agree that if you do not collect your submission by the agreed collection date, it:

    a) will be deemed to have been abandoned

    b) will become the property of Council; and

    c) may be disposed of in any manner as Council sees fit, including by sale or auction.
     

  14. Nothing in these terms and conditions or in the conduct between you and Council creates a relationship of agency, partnership, employer and employee or joint venture between you and Council.
     
  15. If for any reason, the project cannot be run as planned, Council reserves the right, acting in its absolute discretion, to cancel, terminate, modify or suspend the project and/or change these terms and conditions at any time.
     
  16. Council’s decisions are final and no correspondence will be entered into.
