As COVID-19 restrictions ease, Wyndham City is working with businesses to make it as easy as possible for operators to welcome people safely back to our city.
There are a range of opportunities for local businesses to start or increase their outdoor trading space to maximise the number of customers that they can serve, while adhering to State Government's guidelines, including social distancing and density requirements.
With the support of grant funding from Victorian Government’s Outdoor Eating and Entertainment Package, Wyndham City will deliver a number of projects to support businesses with more options as they adapt to new models of outdoor dining in a safe and practical way.
This includes support for alfresco dining precincts, investment in outdoor dining sets and safety infrastructure, free and streamlined permitting options, activations and marketing support.
As we respond quickly to these changing conditions, this may need further adjustment as we go.
Applications are now open for Wyndham’s free, fast-tracked Footpath Trading Permit, with fees waived to 31 August 2021. You can:

- Apply to extend an existing Footpath Trading Permit (eg additional furniture)
- Apply for a Footpath Trading Permit in front of neighbouring businesses (with their agreement)
Businesses in shopping strips, town centres and activity centres who are already using footpath trading to full capacity, may also apply for a Temporary Commercial Use of Outdoor Space Permit.
Footpath Trading Permits
There is no cost to commence or expand your outdoor trading area by applying for a Footpath Trading Permit. This includes use of things like tables, chairs, display of goods and A-frame signs. Permit fees have waived to 31 August 2021 with a fast-track review of applications with target of 5 business days. Use the Footpath Trading Permit Form:

- Apply for a Footpath Trading Permit in front of neighbouring businesses (with their agreement).
Temporary Commercial Use of Public Space Permit
Wyndham City will also consider temporary commercial use of Council-managed public space including with applications open for business operators in shopping strips, town centres and activity centres, provided:
- A Footpath Trading Permit is in place and you are fully utilising the available space, including neighbouring properties (if applicable and with their approval) and are seeking more space adjoining, adjacent or in close proximity to your business, OR
- A Footpath Trading Permit is not an option due to footpath size or safety reasons. Please check here for Footpath Trading Guidelines and Permit Application.
The Temporary Commercial Use of Public Space Permit may include applications for Council-managed areas such as streets, car parks and open space in town centres and shopping centres.
It excludes the use of parks and reserves.

As part of this permit process, Wyndham City has a suite of free, outdoor dining sets available for temporary business use, including parklets, outdoor dining sets and alfresco pods. Council will work with businesses to determine if any of these elements may be suitable as part of your application.

Free Parklets, Alfresco Pods and Outdoor Dining Kits
Safety is a priority, particularly as businesses seek to expand their outdoor footprint into Council managed kerbside and street-based areas in our city centres and shopping strips.
Wyndham City is supporting businesses with free use of a flexible suite of outdoor dining infrastructure to help introduce new model of kerbside dining, safely.
As part of the permit process for Temporary Commercial Use of Public Space, Council will work with businesses to determine if any of these elements may be suitable as part of their application.
Kits are limited and are for temporary use as part of permit conditions.
Following Wyndham City’s parklet pilot in June, we took feedback from local businesses on how they were used and what they offered. In response to this feedback, we’ve made changes to the design and use of these parklets, and their placement will be guided by the local business community.
Three parklets will be installed in Hoppers Junction in early November and up to three parklets will be available to interested businesses in Werribee City Centre with expressions of interest via the Temporary Commercial Use of Public Space Permit application process.
Each parklet includes 39m2 (capacity six people) and can be located within three parking spaces. The units include a base frame with walled protection and decking to meet the kerb, timber bench seating, tables, market umbrellas, fairy lights and hand sanitiser stations.
Outdoor Dining Kits
We have up to eight pop up outdoor dining kits available for use with expressions of interest via the Temporary Commercial Use of Public Space Permit application process. Each kit includes 26m2 (capacity 10 people) that can be located within two parking spaces. Each kit includes decking to align with the kerbside (with options for parallel and angled parking), safety planter boxes, plants and sanitising station.
We have up to four alfresco pods available for use with expressions of interest via the Temporary Commercial Use of Public Space Permit application process. Each pod includes 13m2 (capacity 10 people) and can be located within one car park. These units feature walled protection, multiple options for shade/cover and internal ledge, providing flexible integration with business seating and or tables.
Dining Precincts, Partnerships and Marketing
Wyndham City is providing partnership support for dining precincts in Point Cook Town Centre and Point Cook Soho Village in the form of removable, engineered, in-road bollards – a key step for those precincts to be able to utilise a section of the Council-managed street to develop flexible outdoor dining options.
Council will also install 10 additional temporary outdoor seating units in the existing grassed area of Station Place in Werribee City Centre to provide additional, shared space for customers to use.
If your business is located within a privately owned and managed shopping centre, contact your Centre Manager about options to extend your trading area. In instances where use of Council-managed land such as streets, car parks and outdoor space may form part of an outdoor dining solution, Council can then assist with advice on permits and access options.
Outdoor Dining Marketing Support
An outdoor dining marketing campaign will also help residents and visitors rediscover and find new dining favourites in a COVID-safe way. All hospitality businesses and precincts in Wyndham will be able participate in and leverage this free marketing campaign.
West End Experience
In response to interest from local businesses and with further business consultation underway, Wyndham City is also exploring a pop up ‘West End Experience’ between Bridge Hotel and Wedge Street Piazza that could help businesses extend their outdoor dining offer in the form of a series of one-day pilot activations.
This new initiative would see the west end of Watton Street in the Werribee City Centre transformed into a must-visit, summer outdoor dining destination, with businesses able to expand their footprint into a larger alfresco space spreading out across the street.
This would be delivered in the form of a series of one-day pilot activations where the shared space is created and then de-installed at the end of the day, with the potential to build to a multi-day experience.
No single business would own the space, and all local businesses would be invited to participate, with provisions for delivery services, public car parking and emergency vehicle access.
Businesses within Shopping Centres
If your business is located within a privately-owned and managed shopping centre contact your Centre Manager about options to extend your trading area, as Council doesn’t manage this land.

How much does this cost?
Fees associated with applying for a Footpath Trading and the Temporary Commercial Public Use of Open Space Permit have been waived. This is a free application until 31 August 2021.
How long will it take to process?
Review of applications will be fast-tracked. Businesses who apply for a Footpath Trading Permit can expect to have their application considered in 5 business days, provided all of the relevant information is received. Temporary Commercial Use of Public Space Permits will be considered on a case by case basis, with target review period of 10 businesses days.
How long will permits be valid?
Footpath Trading Permits will be valid until 31 August 2021. The duration of Temporary Commercial use of Public Space Permits will be determined on a case by case basis.
When can I apply for a permit?
Applications are now open. Please review the Victorian Government Metropolitan Melbourne Roadmap for more information about business trading restrictions and requirements.
Will I need a planning permit?
The Victorian Government has introduced exemptions to the Victorian Planning Scheme Clause 52.18 to support the hospitality sector transition to outdoor dining as part of the response to COVID-19.
The exemptions will make it easier for hospitality businesses (including restaurants, cafes, take away food premises, bars and convenience restaurants) to modify their operations on their own properties and public land managers to make land available for outdoor dining without the need to obtain a planning permit, subject to conditions.

In Wyndham,permits are required for businesses seeking use of Council-managed land such as footpaths, public car parks, streets or open space, via the Footpath Trading Permit and Temporary Commercial Use of Outdoor Space Permit.
My business trades next door to a business not using their footpath. Can I expand into their footpath?
We encourage businesses to work with their neighbours to establish an agreement of expanding footpath trading. If a neighbouring business does not trade on their footpath, and does not plan to, an expansion is permitted only with written consent from the business which can be submitted through the Footpath Trading Permit application form.
What information will I need to provide?
You will need to include information about the type of activity or service you are looking to provide, the size of the trading area, furniture and measurements along with a copy of your Public Liability Insurance.
Do I need Public Liability Insurance?
Yes. Businesses will need to ensure they have public liability insurance in place before commencing to trade in public spaces like footpaths and other outdoor public spaces.
I have a liquor license. Will this extend to public spaces or footpaths?
Businesses will need to apply for a liquor licence for their new outdoor trading area or apply to vary an existing licence for extended areas. The Victorian Commission for Gambling and Liquor Regulation have introduced a streamlined process to help existing licensees temporarily use public outdoor areas to supply liquor in line with the Victorian Government’s roadmap to reopening. Do usual trading hours or hours of operation apply to footpath trading and trading in outdoor public spaces?
Trading hours for Temporary Commercial use of Public Space will reviewed on a case by case basis, with consideration of safety and public impact.
The footpath may be used for trading in accordance with the hours of business currently allowed under the trader’s planning permit or where applicable, the liquor permit, with all furniture to be removed and the footpath kept clear for street cleaning between 11pm – 8am.
What other requirements do hospitality businesses need to adhere to?
All Victorian businesses require a COVID-Safe plan to operate and must follow the Victorian Government’s roadmap to reopening, which includes seating and density limits.
Businesses also need to comply with Food Safety, Liquor Licensing and Tobacco Guidelines.

What are the proposed social distancing and density requirements for outdoor dining?
Under the Victorian Government’s Third Step of the Roadmap to Reopening the following density quotient applies for outdoor spaces. You can read more about indoor and outdoor dining requirements in our Public Health and Food Safety Guide.
- Density quotient outdoors of one person per 2 metre squared.
- A cap of 50 patrons per venue outdoors subject to the density requirements.
- The density quotient must be applied in all outdoor spaces in a venue.
- No more than 10 patrons per booking.
- Patrons must be seated so they are 1.5m away from any patron from an adjacent group.
Where do I begin?
You must first apply for a Footpath Trading Permit and ensure all space is being utilised before applying for a Temporary Commercial Use of Public Space Permit. Of course, some exemptions apply. For example, for businesses where the footpath is too narrow to operate from may also be able to apply. We encourage operators to start thinking how this can work for your business and encourage you to utilise existing space in the first instance and work with your neighbours.
Will I have to pay for the furniture to trade or operate outdoors?
