Building Litter


Litter and building rubble must be securely contained on the building site and removed during or on completion of construction.

Local Law 3

Local Law 3 - Protection of Council Assets and Control of Building Sites - came into effect in July 2000, with the aim of protecting Council assets like footpaths and kerbs from damage by building activities, controlling litter generated by building activities and making it a requirement to have sanitary facilities on building sites. This local law was recently amended requiring:

The builder must prior to commencement of any works erect site fencing to the following requirements:

(1) Prior to the commencement of any building work the owner, builder or appointed agent must ensure that a site fence is erected on each individual site that complies with the following requirements:

(a) The site fence must:
(i) be not less than 1500mm in height; and
(ii) be capable of preventing litter from being transported from the site by wind; and
(iii) have not more than one access opening to the site which is:

  • not greater than 2800mm in width;
  • fitted with gates not less than 1500mm in height that prevent litter from being  transported from the site by wind;
  • located to correspond with the location of the temporary vehicle crossing for the building site; and
  • kept closed at all times when works are not in progress.

(2) The entire site fence is to be erected on the boundary of the site’s property line and must not protrude in or on any land other than the building site directly on which the building work is occurring.

a. If a builder has more than one adjoining site then the site fencing may enclose all of the sites under the builder’s control.
b. Each section of the entire fence is to be erected as close as practicable to vertical at all times and must remain erected until the completion of the building work.
c. The site fence must remain erected and in place until the completion of the building work.

Subdivisions now have to erect signage in front of their subdivision site detailing:

  • The name of the person or organisation that owns the subdivision
  • the name and details of the person in charge of the site;
  • the postal address of the person in charge; and
  • a 24 hour business telephone contact.

The owner, builder or appointed agent must ensure that all residual polystyrene foam material is removed from the site by 5.00pm on the date of the slab being poured

Penalty:  $200 for a first offence
$500 for a subsequent offence
