Why do I need to obtain a permit?

There is a requirement to obtain a permit under Council Local Laws.

 

From a pure legal point the implementation of the Footpath Trading Policy and Guidelines Policy is also required to comply with the Federal Disability Discrimination Act, improve overall risk management and provide clear guidance for traders wishing to use public space.

 

In part the Guidelines aim to provide orderly placement of furniture and signs; ensuring that the amenity of the business streetscape is not compromised with disorderly clutter and that the shop front windows and promotional signage of one business is not negatively impacted by inappropriate furniture or signage from a neighbouring business.

 

This initiative has been undertaken following legal advice, feedback from traders and advice from Council's insurers.

 

What is the cut off date for permit application for premises currently using public space?

 

90 Days grace has been provided to allow premises to make any adjustments that may be required to obtain a permit this period expires on 14 December 2009

 

I don't have an application for a permit, where can I get one from?

 

 

What are the costs involved in obtaining a permit?

 

There is a one off non refundable application fee of:

A Frame Signs  $170
Tables, Chairs, Umbrellas and Screens $170
Real Estate Pointer Signs $170
Plus an Annual Permit Fee of:  
A Frame Signs (per sign) $62
Unlicensed premised   $56 for first 2 tables then $112 for each additional table
Licensed Premised $170 per table
Real Estate Agent Pointer Signs $62 per sign or $500 for a city wide permit

                                        

How long will it take for my permit to be approved?

 

When a fully completed application and payment have been received it will take approximately 10 working days.

 

How long does the permit last? How do I renew it?

 

Permits are valid from the date of issue for 12 months.  You are required to renew your permit no later than 30 days before the current permit expires.

 

Can I obtain a permit to display goods for sale on the footpath?

 

No. You are not allowed to keep saleable goods on the footpath and can be fined for doing so.

 

Can I keep goods for sale on the footpath?

 

No. You are not permitted to place goods out for sale.

 

Can I keep chairs and tables on the footpath without a permit?

 

No.  You must obtain a permit and comply with all policy guidelines or you may be subject to fines.

 

Can I keep patio heaters on the footpath?

 

Yes.  Patio heaters can be placed on footpaths with a permit, but must be installed/placed as per the policy guidelines.

 

Can I keep an A frame sign on the footpath without a permit?

 

No.  You must obtain a permit to place an A frame sign on the footpath, and the  A frame sign must not exceed 0.7 metres in width or 1 metre in height, and must be placed as per the policy guidelines.

 

Real Estate Pointer boards must not exceed 0.7 metres in width or height and must be placed in accordance with the Policy & Guidelines.
