Property Damage or Personal Injury Claims
Making a claim
All claims or request for compensation must be submitted to Council in writing. The claim letter must contain a detailed description of the circumstances and include:
- What happened
- When it happended
- Where it happened (with sketch plan)
- What is the damage or injury
- Proof of value of claim (invoices, quotations etc)
- Why it is believed that Council is liable

What happens when Council receives a claim in writing?
Council will acknowledge receipt of your claim by sending you a written claim. The Council will investigate th claims made by you to determine the best course of action. At this time Council may request additional information from you to assist with the investigation of the matter.
You will be told within 14 days whether Council has accepted or rejected your claim or whether it ahs been referred to someone like Council's insurers or our claim agent to further investigation. If we do not accept your claim, you will be given the reasons behind this decision.
What you should know abou the process....
Council never makes ex gratia payments; we will always process any claim in the correct and formal matter.
There is legislation in place that governs the maintenance of roads and footpaths - this legislation (the Road Management Act 2004) acknowledges that no Council has sufficient resources to constantly check every road and footpath under their control. Wyndham City's liability for accidents due to damaged roads and footpaths is relatively limited. This will impact directly on claims made in such circumstances.
Council is also not responsible for the ations of independent contractors or companies who carry out work on roads and footpaths in the area. They are required to carry their own insurance cover and all claims arising out of the work or action of such companies will be referred directly to them.
